Giving Notice to Access a Tenanted Property

It is surprising how many Landlords who (all be it innocently) do not give the correct written notice when entering a rental property.

Imagine your tenant waking up on a Sunday morning, still in their PJ’s to find the Landlord waving at them through the window with an unexpected visit or inspection!  As funny as it may sound, it’s not acceptable practice and a Landlord can be financially penalised for not giving the appropriate notice.

The Residential Tenancies Act gives specific guidelines in relation to the notice that must be given before entering a rental property plus the frequency of allowed visits. This applies not only to the Landlord/Property Manager but also for the purpose of maintenance, emergencies, collecting rent, inspections, etc.
 
 
The following is a guideline as to what rules Landlords must adhere to when wanting entry to a rental property:
 
Inspections
– Minimum of 48 hours notice and not longer than 14 days notice
– Maximum of 1 inspection within a 4 week period
– Must be conducted between the hours of 8am and 7pm
 
Repairs or Maintenance
– Minimum of 24 hours notice
– Must be conducted between the hours of 8am and 7pm

If you are wanting access for the purpose of showing through prospective Tenants or Purchasers, or obtaining a valuation from a Registered Valuer/Real Estate Agent, or to show through any other expert – no notice can be given, you must first obtain the Tenants consent before you are permitted to enter the property. Now while the Tenant cannot unreasonably refuse access in these situations, we have seen this rule pose great difficulty to the Landlord when access is needed for showing through prospective Tenants after the current Tenants have given notice to vacate and they are unwilling to give consent for viewings.  See here to read about our Blog that talks about what to do in these types of situations.

Although Landlords do not need to give notice to enter the grounds of the property, they must not unreasonably interfere with the Tenants privacy and quiet enjoyment of the property.
